CITY COUNCIL MINUTES
TUESDAY, SEPTEMBER 21, 2004
7:00 P.M.

The Prattville City Council met in regular session on Tuesday, September 21, 2004 at 7:00 p.m. in the Council Chambers at City Hall. Roll was called and all were recorded as being present. After the Pledge of Allegiance to the American Flag, Council President Argo gave the invocation.

APPROVAL OF MINUTES: September 7th Public Hearing and City Council Minutes and September 15th Special Session Minutes.

Councilman Macready made the motion to approve the minutes and Councilman Miller seconded the motion. The minutes were approved (7-0).

COMMENTS FROM PERSONS PRESENT:

Laurie Calloway, 518 Mt. Airy Drive, Prattville, AL 36067, appeared before the Council on behalf of the following residents to voice concerns of speeding motorists, including teenage drivers and school bus drivers on school days, on Mt. Airy Drive and Ridgewood Road: Anita Kelly, 534 Mt. Airy Drive; Jeremy Calloway, 518 Mt. Airy Drive; Stephanie Toxey, 531 Mt. Airy Drive; Vicki Cagle, 532 Mt. Airy Drive; Allen Smith, 509 Mt. Airy Drive; Vince Stevenson, 537 Mt. Airy Drive.

The citizens of Mt. Airy Drive demanded that this issue be dealt with as quickly as possible. They stated that they feared for the safety of their children and their properties. They also stated that reports had been made to the Prattville Police Department regarding two attempted kidnappings in recent weeks. Ms. Calloway also stated the resident’s intentions of signing petitions to have Ridgewood Road closed.

Councilman Renegar suggested that Ms. Calloway contact Superintendent of Education Mr. Larry Butler to report the school buses.

Councilman Wood stated that when he was contacted by Ms. Calloway, he turned a work order in to the Mayor’s office requesting additional police patrol on Ridgewood Road and Mt. Airy Drive. He further stated his opposition to the suggestion of closing Ridgewood Road. He assured Ms. Calloway and other residents that since they had presented the issue to the City Council, appropriate steps would be taken to rectify the problem.

Councilman Miller stated that while speeding motorists pose a problem, he is more concerned with the disturbing information of the attempted kidnappings.

Councilman Macready asked Mr. Calloway for clarification that it was not a school day when his vehicle was struck by a teenage driver. Mr. Calloway stated that it occurred on a Saturday morning.

Councilman Argo commended the neighborhood residents for coming before the Council to state their concerns. He encouraged them to write down tag numbers of vehicles and police car numbers of those who speed through their streets. He informed them that a complaint could be filed by citizens who report traffic violations. Councilman Argo further stated his intentions to form a committee that would monitor traffic in neighborhoods and asked Ms. Calloway to consider serving on that committee. He also asked the residents not to pursue the petition to have Ridgewood Road closed.

Mayor Byard responded to the residents by stating that while he understands their frustration he felt it was important for them to know that neighborhoods throughout the city experience the same problems. He also stated that it isn’t possible to have police officers everywhere all of the time. The Mayor encouraged residents to keep close watch over their children to protect them from speeding motorists and the dangers other individuals may pose.

Mr. Earl Wagoner, 1220 Josephine Avenue, Prattville, AL, appeared before the Council to state his appreciation for the City employees who worked hard to clean up Prattville in the wake of Hurricane Ivan.

MAYOR’S REPORT:

Mayor Byard reported that power had been restored to all residents as of this evening. He expressed his appreciation to the employees who worked during the hurricane and the days immediately following. The Mayor also thanked individuals and businesses who had provided meals for the workers over the last several days.

Regarding the agenda, Mayor Byard asked for council support on Resolution number 7, which allows the City to continue operating after the FY 2004 ends. Due to Hurricane Ivan, budget hearings with department heads were postponed. Those hearings will be rescheduled as soon as possible.

Mayor Byard publicly expressed his appreciation to Councilmen Carter and Hall for their years of service on the Prattville City Council. He spoke of their friendships and of his respect for them as individuals and leaders of the community.

COUNCIL REPORTS:

Councilman Argo recognized Council-elect Gillespie and Fank who were in attendance at the evening’s meeting.

AGENDA ITEMS

1. RESOLUTION: TO ISSUE OFF-PREMISE RETAIL BEER AND WINE LICENSE TO ERIKA BERDEAUX D/B/A RACE TRAC PETROLEUM, INC. (RESOLUTION BOOK 2004, PAGE 074).

Councilman Hall made the motion to adopt the Resolution and Councilman Macready seconded the motion. During discussion, Councilman Hall stated that the Public Safety Committee met regarding this application and found no opposition to it. The vote was called and the Resolution was adopted with the following results:

AYES: CARTER, WOOD, MILLER, ARGO, RENEGAR, MACREADY, HALL 7
NAYS: NONE 0
ABSTAINED: NONE 0
ABSENT: NONE 0

2. ORDINANCE: TO SURPLUS EQUIPMENT FROM VEHICLE MAINTENANCE AND STREET DEPARTMENTS. (ORDINANCE BOOK 2004, PAGE 017).

Councilman Wood made the motion to adopt the Ordinance and Councilman Renegar seconded the motion. Because Ordinances are generally held for two weeks, it is necessary for council rules to be suspended if immediate action is to be taken. Councilman Wood made the motion to suspend the rules and Councilman Miller seconded the motion. The rules were suspended (7-0). There being no discussion, the Ordinance was adopted with the following vote:

AYES: CARTER, WOOD, MILLER, ARGO, RENEGAR, MACREADY, HALL 7
NAYS: NONE 0
ABSTAINED: NONE 0
ABSENT: NONE 0

Councilman Macready made a motion to adopt the Resolution and Councilman Hall seconded the motion. During discussion, Councilman Hall stated that the Public Safety Committee met regarding this application and found no opposition to it. The Resolution was adopted with the following results:

4. RESOLUTION. TO ACCEPT MAINTENANCE OF BURTON MANOR SUBDIVISION PLATS 2, 3, 4 & 5. (RESOLUTION BOOK 2004, PAGE 076).

Councilman Carter made the motion to adopt the Resolution and Councilman Macready seconded the motion. There being no discussion, the Resolution was adopted with the following results:

AYES: CARTER, WOOD, MILLER, ARGO, RENEGAR, MACREADY, HALL 7
NAYS: NONE 0
ABSTAINED: NONE 0
ABSENT: NONE 0

5. RESOLUTION: TO ACCEPT MAINTENANCE OF COVERED BRIDGE SUBDIVISION AND COVERED BRIDGE VILLAGE SUBDIVISION. (RESOLUTION BOOK 2004, PAGE 077).

Councilman Renegar made the motion to adopt the Resolution and Councilman Macready seconded the motion.

Councilman Renegar made the motion to suspend the rules and Councilman Wood seconded the motion. The rules were suspended (7-0). The vote to adopt the Resolution was called and the results were as follows:

AYES: CARTER, WOOD, MILLER, ARGO, RENEGAR, MACREADY, HALL 7
NAYS: NONE 0
ABSTAINED: NONE 0
ABSENT: NONE 0

6. ORDINANCE: REQUIRING CLEANUP OF ANIMAL WASTE.

Councilman Renegar made the motion to adopt the Ordinance and Councilman Hall seconded the motion. Because Ordinances are generally held for two weeks, it is necessary for council rules to be suspended if immediate action is to be taken. Councilman Wood made the motion to suspend the rules. The motion to suspend the rules failed for lack of a second. By point of order, the Ordinance was held for two weeks.

Ordinance Book 2000, Page 012, To Set Council Procedures, specifies in Section 22, that all ordinances, resolutions or propositions submitted to the council which require the expenditure of money shall lie over until the next meeting; provided further, that this rule shall not apply to the current expenses of, or contracts previously made with, or regular salaries of officers, or wages of employees. Therefore, it is necessary to suspend the rules on agenda item number 7.

7. RESOLUTION: APPROPRIATING FIXED EXPENSES AND SALARIES AND CONTINUING POLICY PROCEDURES. (RESOLUTION BOOK 2004, PAGE 078).

Councilman Hall made the motion to adopt the Resolution and Councilman Renegar seconded the motion. During discussion, Councilman Carter stated his opposition to the budget process. He stated that he felt that the Council as a whole did not have ample time to study the proposed budget and he felt that the Council should receive a copy of it when the Finance Committee receives its copy.

Councilman Argo stated that if the Resolution was not adopted, the City would not be allowed to operate after midnight September 30, 2004.

Councilman Macready made the motion to suspend the rules and Councilman Hall seconded the motion. Councilman Miller clarified that the approval of the Resolution allow the City to continue to pay salaries and bills until the new budget is presented and passed by the Council. The rules were suspended (7-0). There being no further discussion, the vote was called and the Resolution was adopted with the following results:

AYES: CARTER, WOOD, MILLER, ARGO, RENEGAR, MACREADY, HALL 7
NAYS: NONE 0
ABSTAINED: NONE 0
ABSENT: NONE 0

8. RESOLUTION: TO SET A PUBLIC HEARING TO REZONE PROPERTY LOCATED OFF OF OLD FARM LANE AND COBBS FORD ROAD FROM FAR TO R-3, R-4 AND B-2. (RESOLUTION BOOK 2004, PAGE 079).

Councilman Miller made the motion to adopt the Resolution and Councilman Wood seconded the motion. There being no discussion, the Resolution was adopted with the following vote:

AYES: CARTER, WOOD, MILLER, ARGO, RENEGAR, MACREADY, HALL 7
NAYS: NONE 0
ABSTAINED: NONE 0
ABSENT: NONE 0

Councilman Miller introduced the proposed Ordinance and made the motion to adopt it. Councilman Macready seconded the motion. By point of order, the Ordinance was held until November 2, 2004.

CLOSING COMMENTS:

Councilman Carter stated that he had enjoyed working with the Mayor and Council over the last four years. He also thanked the Mayor for his words of appreciation and well wishes for his future.

Councilman Wood made a second request to City Planner Joel Duke for the list of properties that had been declared a public nuisance. Councilman Wood also wished God’s blessings on Councilmen Carter and Hall.

Councilman Miller stated that he is currently serving as Chairman of the Autauga County United Way campaign and encouraged the participation of those who were in attendance at the evening’s meeting. Councilman Miller expressed his appreciation for the opportunity to work with and get to know Councilmen Carter and Hall.

Councilman Renegar wished Councilmen Carter and Hall “the best life has to offer”.

Councilman Macready stated that Councilmen Carter and Hall will be missed at City Hall.

Councilman Argo announced that the Council orientation would be held on Monday, September 27th at 6:00 p.m. at the Performing Arts building. He also mentioned the Swearing-In ceremony on October 4th at 10:00 a.m. in the Council
Chambers at City Hall. Councilman Argo encouraged everyone to attend the Autauga County Fair which opened today and runs through Saturday, September 25th.

Councilman Argo thanked Councilman Carter for his years of service on the City Council and expressed his appreciation for causing him to pay more attention to details. He also thanked Councilman Hall for his friendship and for the role he plays in the lives of his children.

Councilman Hall stated that he had enjoyed his years of service on the City Council and further stated that he felt confident that Mr. Fank would serve the City well.

ADJOURN:

There being no further business to come before the Council, Councilman Macready made the motion to adjourn and Councilman Hall seconded the motion. The meeting closed at 8:25 p.m.
