CITY COUNCIL MINUTES
TUESDAY, NOVEMBER 2, 2004
7:00 P.M.

The Prattville City Council met in regular session on Tuesday, November 2, 2004 at 7:00 p.m. in the Council Chambers at City Hall. Roll was called and all were recorded as being present. After the Pledge of Allegiance to the American Flag, Council President Argo gave the invocation.

APPROVAL OF MINUTES: October 19th City Council Minutes. Councilman Macready made the motion to approve the minutes and Councilman Miller seconded the motion. The minutes were approved (7-0).

COMMENTS FROM PERSONS PRESENT:

Charles Phillips, 6012 Meridian Lane, appeared before the Council on behalf of the Autauga County Humane Society. Mr. Phillips serves as President of the Humane Society. He thanked the Council for their past support and asked for consideration in their request for $82,800.00 in the FY 2004-2005 budget. He stated that the shelter is currently understaffed and is lacking in the number of volunteers from which they started last year.

Councilman Renegar questioned Mr. Phillips about the location of his residence on Meridian Lane and Mr. Phillips stated that Meridian Lane is in Montgomery, AL.

Councilman Macready asked Mr. Phillips the amount of their request to the Autauga County Commission and Mr. Phillips stated that it was $67,000.00.

Councilman Miller commended Mr. Phillips on his commitment and persistence in dealing with issues regarding the humane shelter. He also recognized members of the Humane Society who were in attendance at the evening’s meeting.

Councilman Argo questioned the difference in the amounts of their request to the Autauga County Commission for $67,000.00 and $82,800.00 to the City. Mr. Phillips stated that more animals are picked up and dropped off within the city limits than those from out in the County. Councilman Argo reminded Mr. Phillips that when the shelter opened, the City provided them with a paid employee, a vehicle for hauling animals, and the proper equipment used by a dog warden. He also stated that the County had provided them with an employee who is no longer at the shelter, and further inquired as to whether that employee had been replaced. Mr. Phillips verified that he had been replaced.

Mr. Argo stated that it has been rumored that the “Taste of Prattville”, which is an Autauga County Humane Society benefit, had been canceled. He asked Mr. Phillips to notify the Council of the reschedule date so that members could have the opportunity to attend.

MAYOR’S REPORT:

Mayor Byard thanked Mr. Phillips and other members of the Humane Society for their attendance at the council meeting. He also commended Councilman Miller for the job he had done as the City’s liaison in dealing with the Humane Society.

Regarding the United Way Campaign, the Mayor credited Lisa Thrash, City of Prattville Human Resources Administrator, Councilman Tom Miller, Chairman of the Autauga County United Way, and Brooke Abbott, United Way Ambassador, for the City’s increase in contributions for 2004-2005. The Mayor stated that city employees gave $9,283.92 to United Way last year, and to date, employees have committed to $13,003.28 for 2004-2005.

In reference to the agenda, Mayor Byard asked that a Finance Committee meeting be held regarding Resolution number 2, which deals with the downtown creek walk and parking project.

The Mayor presented the Council with the FY2004-2005 budget and requested a work session to discuss it at length.
Councilman Miller thanked the Mayor for his support of the United Way Campaign.

COUNCIL REPORTS:

AGENDA

1. ORDINANCE: REQUEST TO REZONE PROPERTY LOCATED OFF OF OLD FARM LANE AND COBBS FORD ROAD FROM FAR TO R-3, R-4, AND B-2. (RESOLUTION BOOK 2004-A, PAGE 018).

A public hearing was held at 6:00 p.m. this evening. The Resolution was adopted with the following results:

AYES: GILLESPIE, WOOD, MILLER, ARGO, RENEGAR, MACREADY, FANK 7
NAYS: NONE 0
ABSTAINED: NONE 0
ABSENT: NONE 0

2. RESOLUTION: TO AUTHORIZE THE MAYOR TO ENTER INTO AN AGREEMENT WITH CARDWELL CORPORATION FOR DOWNTOWN REVITALIZATION PHASE II CREEK WALK AND PARKING PROJECT.

The Resolution was held from the October 19, 2004 council meeting. Councilman Renegar made the motion to hold the Resolution indefinitely and Councilman Macready seconded the motion. The Resolution was held indefinitely (7-0).

3. RESOLUTION: TO SET A PUBLIC HEARING TO GRANT A LOUNGE RETAIL LIQUOR CLASS II PACKAGE STORE LICENSE TO AURO SWAMY, D/B/A S&S EAGLES, LLC. (RESOLUTION BOOK 2004-A, PAGE 009).

Councilman Macready made the motion to adopt the Resolution and Councilman Renegar seconded the motion. There being no discussion, the Resolution was adopted with the following results:

AYES: GILLESPIE, WOOD, MILLER, ARGO, RENEGAR, MACREADY, FANK 7
NAYS: NONE 0
ABSTAINED: NONE 0
ABSENT: NONE 0

4. RESOLUTION: TO ADOPT THE CITY OF PRATTVILLE FISCAL YEAR 2004-2005 GENERAL OPERATING FUND BUDGET.

Councilman Renegar made the motion to adopt the Resolution and Councilman Macready seconded the motion.

Councilman Renegar made the motion to hold the Resolution until a Finance Committee meeting and a work session could be held to discuss the proposed budget. Councilman Wood seconded the motion to hold. The Resolution was held until the November 16th council meeting (7-0).

5. RESOLUTION: TO SUPPORT OLD FARM LANE IMPROVEMENTS. (RESOLUTION BOOK 2004-A, PAGE 010).

Councilman Miller introduced the Resolution and made a motion to adopt it. Councilman Renegar seconded the motion.

During discussion, Councilman Miller questioned the Mayor if the passage of the Resolution obligated the City’s commitment to the plan as presented. The Mayor stated that it would not. He further stated that the Resolution shows that the City of Prattville is in favor of working with Autauga County, Elmore County and the Alabama Department of Transportation on the expansion of Old Farm Lane. There being no further discussion, the Resolution was adopted with the following vote:

AYES: GILLESPIE, WOOD, MILLER, ARGO, RENEGAR, MACREADY, FANK 7
NAYS: NONE 0
ABSTAINED: NONE 0
ABSENT: NONE 0

Having voted on the prevailing side, Councilman Miller made the motion to revisit Ordinance number 1. Councilman Fank seconded the motion. All were in favor of revisiting the Ordinance (7-0). During discussion, Councilman Miller stated that during the Public Hearing, City Planner Joel Duke had requested that the Council amend the Ordinance by removing R-4. Councilman Miller made the motion to amend the Ordinance by striking “R-4” from the title, “R-4” from line 21, and the words “multi-family residential” from line 22. Councilman Renegar seconded the motion. All were in favor of the amendment (7-0). The Resolution was adopted as amended (7-0).

CLOSING COMMENTS:

Mayor Byard reminded members of the Council of Veterans’ Day, which is Thursday, November 11, 2004. He invited those in attendance to honor our veterans by attending the following ceremonies : Autauga County Courthouse at 11:00 a.m.; Prattville Memorial Gardens at 12:30 p.m.

Councilman Wood inquired as to whether garbage would be picked up on Thursday. The Mayor stated that the sanitation department would be closed on Thursday but that the entire city would be picked up on Friday.

Councilman Miller called a Fire Committee meeting on Tuesday, November 9th at 7:00 a.m.

Councilman Renegar called a Leisure Services Committee meeting on Monday, November 8th at 4:00 p.m.

Councilman Argo called a Finance Committee meeting for Monday, November 8th at 5:15 p.m. in the Mayor’s office and a work session for Monday, November 15th at 6:00 p.m. at Doster Community Center.

ADJOURN:

There being no further business to come before the Council, Councilman Macready made the motion to adjourn and the motion was seconded. The meeting closed at 7:40 p.m.
