PUBLIC HEARING MINUTES
TUESDAY, JUNE 7, 2005
6:00 P.M.

The Prattville City Council met in Public Hearing on Tuesday, June 7th at 6:00 p.m. in the Council Chambers at City Hall with Council President Argo presiding. Roll was called and all were recorded as being present.

AGENDA ITEMS

1. RESOLUTION: TO DECLARE VARIOUS WEEDED LOTS TO BE A PUBLIC NUISANCE AND ORDERING THEIR ABATEMENT PER § 11-67-1 ET. SEQ., OF THE CODE OF ALABAMA, 1975, AS AMENDED.

No one appeared in favor of the Resolution.

Ms. Peggy Raines, 169 Primrose Drive, appeared before the Council to request an additional 3 weeks to allow for the clean up of her property.

City Planner Joel Duke stated that if the Council adopts the Resolution at the council meeting, the next step will be for the City to contract with a lawn care service to have the property cut and cleaned up.

Councilman Gillespie asked Ms. Raines if she planned to purchase a lawn mower. She stated that a lawn mower was not in her budget.

Councilman Miller spoke of the public health aspect and the decline in property value posed on neighbors in the subdivision. He further stated that it wasn’t fair to her neighbors for her to allow her property to be declared a nuisance.

Mayor Jim Byard, Jr. appeared as a disinterested party to state that city employee Robert Robinson met with him regarding the corner lot property located at Court and Ninth Streets. Mr. Robinson stated that the property belonged to his brother Reverend Timothy Robinson, who recently passed away. Robert’s family has plans to make a decision as to what will become of the property. They respectfully requested an extension to allow the family an opportunity to resolve the weeded lot issue.

Councilman Wood requested a 3 week extension due to circumstances the Robinson family has been faced with.

Mr. Duke urged members of the Council to move forward with the adoption of the Resolution. He also stated that property owners could go forth with the clean up process prior to the date a contractor would start work.

Mayor Byard stated that if the Council would adopt the Resolution, he would insure that the Administration would not contract with a professional lawn care service for at least 3 weeks, which would allow the appropriate amount of time for property owners to avoid additional fees.

2. ORDINANCE: REQUEST TO REZONE PROPERTY LOCATED AT INTERSTATE COURT OFF OF HIGHWAY 14 EAST FROM FAR TO B-2.

Mr. Joe Turner, 511 Mossy Oak Ridge, Prattville, Al 36066, appeared as representative of Mr. Dennis Patel, owner of the property to be rezoned.

Councilman Wood questioned what type of business would be built and Mr. Turner stated that Mr. Patel plans to build a hotel. Councilman Wood asked if Mr. Turner was privy to information that the cul-de-sac on that property would be extended. Mr. Turner stated that he did not have that information.

Mr. Duke reminded members of the Council that the Planning Commission approved the request for rezoning.

No one appeared in opposition to the Ordinance.

3. RESOLUTION: TO GRANT A RESTAURANT RETAIL LIQUOR LICENSE TO WILLIAM POSKE D/B/A OUTBACK STEAKHOUSE.

Mr. Bill Poske and Mr. Rob Regan, representatives of the Outback Steakhouse, appeared before the Council in favor of the application.

No one appeared in opposition to the Resolution.

ADJOURN:

There being no further business to come before the Council, Councilman Fank made the motion to adjourn and the motion was seconded. The meeting closed at 6:25 p.m.
