CITY COUNCIL MINUTES
MONDAY, DECEMBER 5, 2005
7:00 P.M.

The Prattville City Council met in regularsession on Monday, December 5th at 7:00 p.m. in the Council Chambers at City Hall. Roll was called and Councilman Fank was recorded as being absent. After the Pledge of Allegiance to the American Flag, Councilman Renegar gave the invocation.

APPROVAL OF MINUTES: November 23rd Special Session Minutes. Councilman Macready made the motion to approve the minutes and Councilman Gillespie seconded the motion. The minutes were approved (6-0).

COMMENTS FROM PERSONS PRESENT:

Dave Wheary, 4801 West Woolworth Avenue, Milwaukee, Wisconsin, appeared before the Council as a representative of American Signal Corporation. American Signal is one of three companies who responded to a bid that was let by the City of Prattville for outdoor warning sirens. Mr. Wheary informed the Council that his company already has one warning siren system in place in Autauga County, and it is his belief that for that reason, it should not be necessary for his company to meet the required ISO 9001 certification, as stated in the bid specifications.
He further asked to be notified with information as to the reason his company would not be awarded the bid if the Council chooses to award it to another company.

Mayor Byard informed Councilmembers that Fire Chief Stanley Gann, Autauga County Emergency Management Director Randy Taylor, and City Attorney David McDowell had met last week regarding this issue to discuss and carefully consider the particulars of the bid specifications. He further stated that he was under the impression that because the 2006 capital budget hasn’t been adopted, the local match for the weather sirens could not be approved at this time.

MAYOR’S REPORT:

Mayor Byard reported on an accident last Thursday, December 1st involving a City of Prattville garbage truck. A private citizen struck the garbage truck from the rear causing substantial damage to her car and to the City’s truck. The driver of the car sustained undetermined injuries and Sanitation Department employees who were in the cab of the truck were treated for minor bruises.

Former City Councilman Gene Hall was involved in an automobile accident this afternoon in Prattville. He was treated and released from the hospital.

Mayor Byard reminded members of the Council of the City’s Christmas luncheon which is scheduled for Wednesday, December 14th at Doster Community Center from 11:00 a.m. until 1:30 p.m. He encouraged everyone to attend and asked that they contact Drew Peterson to ensure that enough food will be prepared.

The Mayor reported on the success of the Citgo Bassmaster championship, which was held in Prattville last weekend.

Mayor Byard informed the Council that William Oates was named Firefighter of the Year at the annual Fire Department Awards Banquet that was held on Friday, December 2nd.

The Mayor mentioned the success of the Christmas parade on Saturday, December 3rd. Thousands of citizens lined Main Street to watch the 2-hour long parade.

COUNCIL REPORTS:

Councilman Macready reported that the Public Safety Committee met regarding the application for a Restaurant Retail Liquor License for Prattville Pasta Mill, LLC and recommended its approval.

AGENDA ITEMS

1. RESOLUTION: TO GRANT A RESTAURANT RETAIL LIQUOR LICENSE TO ELLEN VIVONE AND ANDREW FRANCIS JONES D/B/A PRATTVILLE PASTA MILL, LLC. (RESOLUTION BOOK 2005-A, PAGE 020).

Councilman Macready made the motion to adopt the Resolution and Councilman Gillespie seconded the motion. There being no discussion, the Resolution was adopted with the following results:

AYES: GILLESPIE, WOOD, MILLER, ARGO, RENEGAR, MACREADY

ABSTAINED: NONE 0
ABSENT: NONE 0

2. RESOLUTION: TO SET A PUBLIC HEARING TO REZONE PROPERTY LOCATED ON PEACHTREE STREET FROM R-6 TO B-1. (RESOLUTION BOOK 2005-A, PAGE 021).

Councilman Wood made the motion to adopt the Resolution and Councilman Renegar seconded the motion. There being no discussion, the Resolution was adopted with the following results:

AYES: GILLESPIE, WOOD, MILLER, ARGO, RENEGAR, MACREADY

ABSTAINED: NONE 0
ABSENT: NONE 0

Councilman Wood introduced the proposed Ordinance and made a motion to adopt it. By point of Order the Ordinance was held until the January 3, 2006 council meeting.

3. RESOLUTION: TO AWARD BID NO. 05-030 FOR OUTDOOR WEATHER WARNING SIRENS TO COMM SERVE, INC.

Councilman Miller made the motion to adopt the Resolution and Councilman Gillespie seconded the motion. Councilman Macready made a motion to hold the Resolution until the 2006 capital budget is passed. Councilman Gillespie seconded the motion. The Resolution was held (6-0).

CLOSING COMMENTS:

Councilman Renegar wished safe travel to everyone who would be attending the National League of Cities Conference in Charlotte, North Carolina.

Councilman Argo also wished everyone safe travel and reminded those in attendance of the next council meeting, which is scheduled for Tuesday, December 20, 2005.

ADJOURN:

Councilman Macready made a motion to adjourn and the motion was seconded. The meeting closed at 7:25 p.m.
