CITY COUNCIL MINUTES
TUESDAY, May 2, 2006
7:00 P.M.

The Prattville City Council met in regular session on Tuesday, May 2nd at 7:00 p.m. in the Council Chambers at City Hall with Council President Argo presiding. Roll was called and all were recorded as being present. After the Pledge of Allegiance to the American Flag, Councilman Wood gave the invocation.

APPROVAL OF MINUTES: April 18th and 21st City Council Minutes. Councilman Macready made the motion to approve the minutes and Councilman Fank seconded the motion. The minutes were approved (7 -0).

COMMENTS FROM PERSONS PRESENT:

Martha Ellis, Executive Director of Peers Are Staying Straight (PASS), 1313 Huie Street, Prattville, AL 36066, and Master Sergeant Cathy Cook, 166 Maple Street, appeared at the evening’s meeting to recognize Mayor Byard for his being one of 26 mayors from across America honored by Youth Service America for his commitment and service to young people.

James Cooke, 1617 Guiding Way, Prattville, AL 36067, came before the Council to ask the Council to look into an allegation made by the manager of Bama Lanes Bowling Alley that the reason for improper lighting in the parking lot is due to on-going electrical problems. Mr. Cooke stated that juveniles are gathering in the dimly lit parking lots and the likelihood for problems to occur are increasing. He urged additional police patrol through the parking lot in the evening hours.

Harrison Davis, Peagler Street, Prattville, AL 36067, appeared before the Council regarding several properties in Council District 2, which should be considered dilapidated structures. Mr. Davis stated that he had previously appeared before the Council regarding these same properties and asked for council support to see that this issue is dealt with properly.

Sarah Stephens of the Prattville Progress recognized several students who are currently involved in the Explorer Program through the Boy Scouts and have expressed an interest in journalism.

MAYOR’S REPORT:

Mayor Byard gave the Council an update on an issue that had come before them at the April 4th council meeting regarding Mr. Joseph Albright, 1050 Spring Street, Prattville, AL 36067. Mr. Albright had expressed concern over an easement problem that involved his driveway which has since been repaired by a private contractor.

Mayor Byard recognized Bryttnee Pickett with a commendation for being chosen as the 2006 Youth of the Year for the State of Alabama Boys and Girls Clubs.

Mayor Byard encouraged everyone to attend a prayer breakfast on Thursday, May 4th at Doster Community Center. Chief Justice Drayton Nabors is scheduled to be the guest speaker.

The Mayor encouraged everyone to attend City Fest May 5, 6, and 7 and invited those present to attend the bridge dedication ceremony on Friday, May 5th at 7:15 p.m. in honor of former Mayor C. Gray Price.

Mayor Byard thanked Street Department Director George Williams and his crew and City Horticulturist Mary Ray and her crew for working together to get the creek walk ready in time for the weekend’s festivities.

Mayor Byard asked that the Council consider going into executive session at the close of the evening’s meeting to discuss an economic development issue.

Councilman Argo asked Mayor Byard if the contractor would be finished with the demolition of the Cobb building prior to City Fest. Mayor Byard stated that the contractor is working diligently to make the area presentable and further stated that for safety reasons, the building will be blocked off but the sidewalk will be open.

Mayor Byard asked the Council to hold a Finance Committee meeting in the near future to discuss the tax holiday.

COUNCIL REPORTS:

Councilman Renegar thanked members of the Council who turned in proposed fee schedules for City facilities.

Councilman Macready stated that the Public Safety Committee met.

AGENDA

1. ORDINANCE: REQUEST TO REZONE PROPERTY LOCATED OFF OF BRIDGE CREEK ROAD FROM FAR TO R-3. (ORDINANCE BOOK 2006, PAGE 015 ).

A Public Hearing was held at 6:00 pm. this evening. Councilman Gillespie made a motion to adopt the Ordinance and Councilman Fank seconded the motion. There being no discussion, the Ordinance was adopted with the following vote:

AYES: GILLESPIE, WOOD, MILLER, ARGO, RENEGAR, MACREADY, FANK 7
NAYS: NONE 0
ABSTAINED: NONE 0
ABSENT: NONE 0

2. ORDINANCE: TO DECLARE ONE (1) DRUG SEIZED VEHICLE SUPRLUS. (ORDINANCE BOOK 2006, PAGE 016).

Councilman Macready made a motion to adopt the Ordinance and Councilman Gillespie seconded the motion. Because Ordinances are generally held for 2 weeks, it is necessary for the rules to be suspended. Councilman Macready made a motion to suspend the rules and Councilman Fank seconded the motion. The rules were suspended (7-0). There being no discussion, the Ordinance was adopted with the following vote:

AYES: GILLESPIE, WOOD, MILLER, ARGO, RENEGAR, MACREADY, FANK 7
NAYS: NONE 0
ABSTAINED: NONE 0
ABSENT: NONE 0

3. RESOLUTION: TO GRANT A RETAIL BEER AND TABLE WINE LICENSE, OFF PREMISE ONLY, TO KENDRICK R. MCCULLOUGH, USA TRAVEL CENTERS, LLC D/B/A PRATTVILLE TRAVEL CENTER #3). (RESOLUTION BOOK 2006, PAGE 043).

Councilman Gillespie made the motion to adopt the Resolution and Councilman Wood seconded the motion. During discussion, Councilman Macready stated that the Public Safety Committee met and it approved the application. The Resolution was adopted with the following results:

AYES: GILLESPIE, WOOD, MILLER, ARGO, RENEGAR, MACREADY, FANK 7
NAYS: NONE 0
ABSTAINED: NONE 0
ABSENT: NONE 0

4. RESOLUTION: TO LEVY 7 MILLS AD VALOREM TAX IN THE CITY OF PRATTVILLE. (RESOLUTION BOOK 2006, PAGE 044).

Councilman Miller made the motion to adopt the Resolution and Councilman Gillespie seconded the motion. There being no discussion, the Resolution was adopted with the following results:

AYES: GILLESPIE, WOOD, MILLER, ARGO, RENEGAR, MACREADY, FANK 7
NAYS: NONE 0
ABSTAINED: NONE 0
ABSENT: NONE 0

5. RESOLUTION: TO AUTHORIZE ADVANCE TRAVEL FUNDS FOR THE ALABAMA LEAGUE OF MUNICIPALITIES CONVENTION IN MOBILE, ALABAMA. (RESOLUTION BOOK 2006, PAGE 045).

Councilman Wood made a motion to adopt the Resolution and Councilman Gillespie seconded the motion. There being no discussion, the Resolution was adopted with the following results:

AYES: GILLESPIE, WOOD, MILLER, ARGO, RENEGAR, MACREADY, FANK 7
NAYS: NONE 0
ABSTAINED: NONE 0
ABSENT: NONE 0

6. ORDINANCE: TO AMEND ORDINANCE BOOK 2006, PAGE 012). (ORDINANCE BOOK 2006, PAGE 017).

Councilman Fank made a motion to adopt the Ordinance and Councilman Macready seconded the motion. Because Ordinances are generally held for two weeks, it is necessary for the rules to be suspended if immediate action is to be taken. Councilman Gillespie made a motion to suspend the rules and Councilman Fank seconded the motion. The rules were suspended (7-0). There being no discussion, the vote was called and the Ordinance was adopted with the following results:

AYES: GILLESPIE, WOOD, MILLER, ARGO, RENEGAR, MACREADY, FANK 7
NAYS: NONE 0
ABSTAINED: NONE 0
ABSENT: NONE 0

CLOSING COMMENTS:

Councilman Renegar encouraged everyone to attend the Garden Reception honoring the award-winning artists of “Paint Autauga,” which is scheduled for Friday, May 5th from 6:00 to 8:00 p.m. at the Prattaugan Museum.

Councilman Argo reminded everyone of City Fest, which kicks off with a street dance along the creek walk behind City Hall on Friday night, May 5th.

At 7:50 p.m. City Attorney David McDowell advised the Council that it was necessary for them to go into executive session to discuss an economic development issue.

Councilman Gillespie made a motion to go into executive session and Councilman Miller seconded the motion. All were in favor (7-0).

At 8:29 p.m. Councilman Macready made a motion to reconvene and Councilman Fank seconded the motion. All were in favor (7-0).

ADJOURN:

There being no further business to come before the Council, Councilman Renegar made a motion to adjourn and Councilman Gillespie seconded the motion. The meeting closed at 8:30 p.m.
