PUBLIC HEARING MINUTES
TUESDAY, OCTOBER 3, 2006

CALL TO ORDER: The Prattville City Council met in public hearing on Tuesday, October 3rd at 6:00 p.m. in the Council Chambers at City Hall. Council President Argo called the meeting to order. Roll was called and Councilman Fank was recorded as being absent.

AGENDA

1. ORDINANCE: TO REZONE PROPERTY LOCATED OFF OF UPPER KINGSTON ROAD BETWEEN 1222 UPPER KINGSTON ROAD AND 1234 UPPER KINGSTON ROAD FROM FAR TO R-3.

Jon Lee Finnegan appeared before the Council on behalf of her friend Ms. Patricia Cummins, 1208 Kenwood Court, Prattville, AL 36067. Ms. Cummins addressed the Council in a letter, which expressed her concerns for this application for rezoning (a copy is attached for the official record).

No one appeared in opposition to the rezoning.

City Planner Joel Duke stated that the sketch plan has not changed from the original plan. He further stated that if the plan had been altered, it would have had to have gone back before the Planning Commission. He also stated that the Planning Commission does not expect a road to connect the two areas in question. Mr. Duke further stated that most drainage issues in the area should be alleviated.

Mr. Duke also stated that these homes will average 1,800 square feet and the trend is for developers to build on smaller lots.

2. ORDINANCE: REQUEST TO REZONE PROPERTY LOCATED OFF OF WEST 5TH STREET AT 152, 158, AND 164 WEST 5TH STREET FROM B-2 AND R-3 TO 0-1.

No one appeared in favor of the rezoning request.

Dr. Jerry Cimis, 141 North Chestnut Street, Prattville, AL 36067, appeared before the Council to make a presentation (a copy is attached for the official record) regarding his concerns for the rezoning request.

Councilman Renegar thanked Dr. Cimis for providing the Council with such detailed information.

Councilman Miller thanked Dr. Cimis for the research he put into his presentation to the Council. He further inquired as to whether the property at 152 West 5th Street had previously appeared on a weeded lot list. Mr. Duke stated that it had. Councilman Miller reiterated his belief that repeat offenders should be penalized.

Mr. Jim Garnett who owns property at 133 West 5th Street, appeared before the Council in opposition to the rezoning request.

City Planner Joel Duke stated that there would not be a problem with holding this request, which would allow land owners the appropriate amount of time to negotiate with the Autauga County Commission.

Councilman Miller questioned Mr. Duke if the Council turns down the rezoning request that the property owners must wait one year to apply for rezoning again and Mr. Duke stated that he was correct.

ADJOURN:

There being no further business to come before the Council, Councilman Macready made a motion to adjourn and the motion was seconded. The meeting closed at 6:45 p.m.
