PUBLIC HEARING MINUTES
TUESDAY, MARCH 6, 2007

CALL TO ORDER: The Prattville City Council met in public hearing on Tuesday, March 6th at 6:00 p.m. in the Council Chambers at City Hall. Council President Argo called the meeting to order. Roll was called and Councilmen Macready and Fank were recorded as being absent.
Councilman Fank arrived at 6:05 p.m.

AGENDA

1. RESOLUTION: REQUEST TO REZONE PROPERTY LOCATED OFF HIGHWAY 31 NORTH BEHIND PRATTVILLE SQUARE SHOPPING CENTER FROM B-2 TO R-5.

The petitioner pulled his request for the rezoning.

No one appeared in favor of or in opposition to the rezoning request.

2. RESOLUTION: TO GRANT A LOUNGE RETAIL LIQUOR LICENSE CLASS I FOR WILLIAM E. & TAMMY WARD, D/B/A THE CELLAR AND SUCH.

No one appeared in favor of or in opposition to the license application.

Recalling a statement by City Attorney David McDowell at a previous meeting, Councilman Miller asked Mr. McDowell for clarification that once a business owner in a particular location has been granted a specific license, then that type of license generally stays with that location. Mr. McDowell stated that he was correct.

3. RESOLUTION: TO SET A PUBLIC HEARING TO REZONE PROPERTY LOCATED ON GOLSON ROAD (COUNTY ROAD 47) AND ADJACENT TO NOLAND FALLS #1.

Greg Gillian with Larry Speaks and Associates appeared as representative for L & E Developers. Mr. Gillian stated that they currently have 94 lots and have plans to connect to Golson Road and Nolland Falls.

Cameron Earnest, Montgomery, AL stated that because these are larger lots, the homes will range from $250,000.00-$275,000.00. He further stated that they had hoped to have smaller lots with homes ranging from $225,000.00-$250,000.00.

City Planner Joel Duke stated that the Developer initially requested R-1 and R-2 but that the Planning Commission asked for the change to R-1 and the Developer agreed. He further stated that as construction progresses there may be opportunity for some R-2.

ADJOURN:

There being no further business to come before the Council, Councilman Renegar made a motion to adjourn and the motion was seconded. The meeting closed at 6:30 p.m.
