PUBLIC HEARING MINUTES
TUESDAY, APRIL 3, 2007

CALL TO ORDER: The Prattville City Council met in public hearing on Tuesday, April 3rd at 6:00 p.m. in the Council Chambers at City Hall. Council President Argo called the meeting to order. Roll was called and all were recorded as being present.

AGENDA

1. RESOLUTION: TO DECLARE 122 E. POPLAR STREET A WEEDED LOT TO BE A PUBLIC NUISANCE AND ORDERING ITS ABATEMENT PER TITLE 11, CHAPTER 67 OF THE CODE OF ALABAMA, 1975, AS AMENDED.

No one appeared in favor of or opposition to the Resolution.

Joel Duke, City Planner stated that this is a standard weeded lot Resolution. He further stated that a notice to clean up the property was sent to the property owner 45 days ago. Councilman Miller questioned if the property owner refused the letter or if it was non- responsive. Mr. Duke stated that it was non-responsive. Mr. Duke stated that procedure is to place a lien on the property once it is cleared. The Council will then affix the cost of clean up and the Autauga County Revenue Commissioner will see that the cost is collected.

2. RESOLUTION: TO REZONE PROPERTY LOCATED OFF OLD RIDGE ROAD FROM FAR TO R-2.

Mr. Bryan Easley, 1234 Ridge Trail, Prattville, AL 36066, appeared before the Council on behalf of East Memorial Baptist Church. Mr. Easley provided members of the Council with photos of drainage and other improvements, which were recently made to the property.

Councilman Miller commended Mr. Easley and his parishioners for their willingness to be good neighbors to the property owners along Old Ridge Road. He further stated that aside from the implementation of the Smoking Ordinance in 2003, he had never received so many emails from citizens who were asking for the Council to support an issue.

Council President Argo stated that he hasn’t heard from any constituents in District 3 who have expressed opposition to the R-2 rezoning. However, he received a call from one resident who had a concern regarding the report of some digging near the Hollybrooke area. Mr. Easley stated that it may have possibly been the Gas Company, but he assured Council President Argo that he would inquire about it. Mr. Argo expressed his desire to see developers share in the cost of bike and walking paths in the Old Ridge Road area. He thanked Mr. Easley and other staff members of East Memorial Baptist Church for being so gracious and kind to deal with during the rezoning process.

Mary Mixon, 101 Strodes Creek Court, Prattville, AL 36066, appeared before the Council to inquire about the additional traffic that may be caused by the proposed rezoning. She further stated that after hearing the discussion, she is satisfied. She also thanked the Mayor and Council for the traffic lights that were recently installed at McQueen Smith Road and Highway 14.

City Planner Joel Duke stated that the Planning Commission gave a favorable recommendation to this rezoning.

ADJOURN:

There being no further business to come before the Council, Councilman Macready made a motion to adjourn and the motion was seconded. The meeting closed at 6:20 p.m.
