PUBLIC HEARING MINUTES
TUESDAY, JUNE 5, 2007

CALL TO ORDER: The Prattville City Council met in public hearing on Tuesday, June 5, 2007 at 6:00 p.m. in the Council Chambers at City Hall. Council President Argo called the meeting to order. Roll was called and Councilman Miller was recorded as being absent.

AGENDA

1. RESOLUTION: TO GRANT A LOUNGE, CLASS II PACKAGE STORE LICENSE FOR EHSON AND KHATIRA KOCHI D/B/A PARTY TYME ON 82, LLC.

No one appeared in favor of or opposition to the Resolution.

Council President Argo questioned City Attorney David McDowell if it had been determined if the City was responsible for licensing a business which is located outside the city limits. Mr. McDowell stated that he had contacted the Alabama League of Municipalities and discussed the issue with one of its attorneys. He further stated that the League’s staff attorney clarified that the City was not legally responsible for approving the license and that the business owners could make application to the Autauga County Commission.

2. RESOLUTION: TO GRANT A RETAIL BEER ON-PREMISE, A RETAIL BEER OFF-PREMISE, A TABLE WINE ON-PREMISE AND A TABLE WINE OFF-PREMISE LICENSE TO MARK TAYLOR, ANDREA TAYLOR, AND WALTER LIVINGSTON D/B/A MARCHELLE’S INC.

Mark Taylor, 166 West Main Street, Prattville, AL 36067, appeared before the Council to ask for support on his request for the alcohol license. He stated that the restaurant had received great reviews since it opened and it is their desire to offer beer and wine to their customers.
No one appeared in opposition to the request.

3. RESOLUTION: TO DECLARE VARIOUS WEEDED LOTS TO BE A PUBLIC NUISANCE AND TO ORDER THEIR ABATEMENT PER TITLE 11, CHAPTER 67 OF THE CODE OF ALABAMA, 1975, AS AMENDED.

George Claire, Prattville, AL 36066, appeared before the Council regarding the weeded lot located at 843 Peachtree Street. Mr. Claire stated that the home is abandoned, the yard is overgrown and the entire property is a danger to the community.

Mr. Otis Smith, 806 Newton Street, Prattville, AL 36067, came before the Council regarding the weeded lot at 814 Newton Street. Mr. Smith stated that he has offered to help the owner with the clean up of the property but the property owner declined his offer. He stated that no one is living in the home and it may pose as a fire hazard.

Jill Hollon, 1157 Faulk Avenue, Prattville, AL 36066, appeared before the Council as representative of her parents Benny and Betty Hollon who own the weeded lot located at 1142 East Main Street. Ms. Hollon provided the Council with photos that prove that this property has been bought under compliance with the weeded lot code. Ms. Hollon requested that Mr. and Mrs. Hollon’s names and address be removed from the Resolution since the property is in compliance.

Council President Argo told Ms. Hollon that there are 18 properties listed in the Resolution and she is the only person who felt it important enough to attend the public hearing. He thanked her for her detailed report and asked that she convey the Council’s appreciation to her parents who were unable to attend.

City Planner Joel Duke stated that of the 18 properties listed, all but 5 have come under compliance. The properties that failed to comply are as follows: 433 Hallmark Drive, 244 Marian Drive, 521 Mt. Airy Drive, 814 Newton Street, and 843 Peachtree Street.

ADJOURN:

There being no further business to come before the Council, Councilman Macready made a motion to adjourn and the motion was seconded. The meeting closed at 6:35 p.m.
