CALL TO ORDER: The Prattville City Council met in public hearing on Tuesday, October 2, 2007 at 6:00 p.m. in the Council Chambers at City Hall. Council President Pro-Tempore Miller called the meeting to order. Roll was called and Council President Argo was recorded as being absent. AGENDA
1. ORDINANCE: TO REZONE PROPERTY LOCATED ON COUNTY ROAD 29 AND ALABAMA HIGHWAY 14 WEST FROM FAR TO B-2.
No one appeared in favor of the rezoning request. Mr. Crawford Jones, owner of the property, contacted the Clerk’s office the day before the council meeting to request that the Ordinance be held due to a conflict in his schedule. Mr. Jones is a farmer and will be picking cotton. Dean Golden, 152 County Road 29, Prattville, AL 36067, appeared before the Council in opposition to the rezoning request. Mr. Golden stated that the owners of the property, which is proposed to be rezoned, met with several concerned residents on County Road 29 to discuss their plans for the use of the property. Mr. Golden further expressed his concerns for the need for a comprehensive development plan for the west side of Highways 14 and 82 in Prattville. He indicated that these are prime areas for commercial development and growth and requested that any rezoning of this nature be postponed until such a plan is developed. Councilman Renegar informed Mr. Golden that the Planning Commission currently has a master plan, which is to be revised this year. He further encouraged Mr. Golden to contact Mayor Byard if has an interest in serving on that committee. Councilman Gillespie thanked Mr. Golden for coming before the Council to share his concerns. Ronnie Robertson, 158 County Road 29, Prattville, AL 36067, appeared before the Council in opposition to the proposed rezoning. He stated that he did not attend the neighborhood meeting with the Jones brothers. He also stated that one of the reasons he moved out to this location was to get away from things such as warehouse storage units. Lena Daniel, 230 County Road 29, Prattville, AL 36067, stated that she is not opposed to storage units, just the proposed location of these particular units. Ms. Daniel also stated that this location would allow them to be visible from the road as well as to the homes that are currently situated in the area. Steven Floyd, 278 Co. County Road 29, Prattville, AL 36067, appeared in opposition to the proposed rezoning. City Planner Joel Duke stated that this property is currently zoned FAR and the Planning Commission recommended the property be rezoned as requested. Councilman Renegar stated that the Planning Commission members discussed how to modify B-2 district rezoning. Councilman Wood questioned if another rezoning is more appropriate. Mr. Duke stated that B-2 fits for the way it is set up. Mr. Duke went on to say that the zoning ordinance could be amended in the future. Councilman Wood asked Mr. Duke if reasonable contingencies could be attached. Mr. Duke responded by saying that could happen as long as they were reasonable and not too selective or too specific. 2. RESOLUTION: TO GRANT A RESTAURANT RETAIL LIQUOR LICENSE TO LOGAN’S ROADHOUSE, INC.
Tyrone Marsee, 411 Lime Creek Bend, Chelsea, AL, appeared before the Council in support of the liquor application. No one appeared in opposition to the request. 3. RESOLUTION: TO DECLARE VARIOUS WEEDED LOTS TO BE A PUBLIC NUISANCE AND ORDERING THEIR ABATEMENT PER TITLE 11, CHAPTER 67 OF THE CODE OF ALABAMA, 1975, AS AMENDED.
No one appeared in favor of or opposition to the Resolution. 4. RESOLUTION: TO CHANGE THE TIME FOR THE 2ND CITY COUNCIL MEETING OF THE MONTH.
No one appeared in favor of or opposition to the Resolution.
ADJOURN:
There being no further business to come before the Council, Councilman Macready made a motion to adjourn and Councilman Fank seconded the motion. The meeting closed at 6:40 p.m.
