PUBLIC HEARING MINUTES
TUESDAY, NOVEMBER 6, 2007

CALL TO ORDER: The Prattville City Council met in public hearing on Tuesday, November 6, 2007 at 6:00 p.m. in the Council Chambers at City Hall. Council President Argo called the meeting to order. Roll was called and all were recorded as being present.

AGENDA

Appeal to Council for Dilapidated Structure for Property Located at 212 Deer Trace.

Mr. Don White, 179 Laurel Wood Drive, Montgomery, AL, representative of Compass Bank, appeared before the Council regarding the property located at 212 Deer Trace, Prattville, AL 36067. Mr. White stated that the owner/builder of the home passed away prior to completing the construction of the home. He further stated that there are currently 3 contracts on the home and the bank is asking the City for a 90-day extension, which will allow the appropriate amount of time to begin foreclosure proceedings.

Councilman Gillespie questioned the safety hazard the property may pose to the surrounding neighbors and Mr. White stated that while the bank can’t actually take possession of the property at this point, he will see to it that the grass is cut and certain areas are properly boarded up.

Councilman Fank asked if an extension of 60 days would be sufficient to accomplish what the bank must do to get the wheels in motion for the foreclosure and Mr. White stated that 60 days would work.

City Planner Joel Duke informed the Council that formal action must be taken by them in the form of a Resolution. Councilman Fank stated that he would have an agenda request for a Resolution to appear on the November 20th agenda.

1. ORDINANCE: TO AMEND PRATTVILLE ZONING ORDINANCE APPENDIX A SECTION 68.

John Pollock, 1817 West 2nd Street, Montgomery, AL 36106, appeared before the Council as Representative of the Central Alabama Fair Housing Center. Mr. Pollock spoke in opposition to the proposed amendment and stated that he learned of the proposed amendment through the media.

Allison Neal, 207 Montgomery Street, Suite 910, Montgomery, AL, appeared before the Council as Representative of the American Civil Liberties Union (ACLU). Ms. Neal spoke in opposition to the proposed amendment and stated that she fears that this may possibly lead to racial profiling.

Council President Argo questioned Mr. Pollock and Ms. Neal if they attended the public hearings in cities such as Troy, Auburn, and Tuscaloosa when they adopted similar Ordinances. Mr. Pollock’s answer was “no.” Council President Argo clarified that the Council’s intent is to see that areas that are currently zoned R-1, R-2, and R-3, remain as they were originally intended to be zoned.

Councilman Miller questioned if Mr. Pollock could offer examples from other communities as to the number of unrelated residents allowed to live in one residence. Mr. Pollock could not give an example.

Councilman Gillespie thanked Mr. Pollock and Ms. Neal for coming before the Council. He further assured them that the Council doesn’t discriminate.

Councilman Wood questioned Ms. Neal if she is aware of a problem with enforcement of this particular type of Ordinance in Alabama. She answered, “not to my knowledge.” Ms. Neal stated that Montgomery’s limit is 5 unrelated persons who may live together in a residence.

2. ORDINANCE: TO REZONE PROPERTY LOCATED AT 250 SOUTH WASHINGTON STREET FROM R-2 TO O-1.

No one appeared in favor of or in opposition to the request.

3. RESOLUTION: TO GRANT A RESTAURANT RETAIL LIQUOR LICENSE FOR TAV PRATTVILLE, LLC D/B/A LAS CASITAS MEXICAN GRILL.

No one appeared in favor of or opposition to the Resolution.

ADJOURN:

There being no further business to come before the Council, Councilman Macready made a motion to adjourn and Councilman Fank seconded the motion. The meeting closed at 6:50 p.m.
