CITY COUNCIL MINUTES
TUESDAY, DECEMBER 4, 2007
7:00 P.M.

The Prattville City Council met in regular session on Tuesday, December 4th at 7:00 p.m. in the Council Chambers at City Hall with Council President Argo presiding. Roll was called and Councilman Fank was recorded as being absent. After the Pledge of Allegiance to the American Flag, Councilman Wood gave the invocation.

APPROVAL OF MINUTES: November 20th City Council minutes.

Councilman Miller made the motion to approve the minutes and Councilman Macready seconded the motion. The minutes were approved (6-0).

COMMENTS FROM PERSONS PRESENT:

Mr. Bob Lee, 112 Quail Run, Prattville, AL 36067, appeared before the Council to suggest that the Police Department conduct an unannounced roadblock to check for uninsured drivers, etc.

Carmen Morris, 228 Radburn Way, Prattville, AL 36067, came before the Council to inform them of an incident in which her son’s small dog had been mauled by his neighbor’s dog. She further urged the Council to implement fines for anyone who is convicted of owning a vicious dog.

Councilman Miller stated that Ms. Morris had placed a telephone call to him regarding this incident. Councilman Miller further requested that appropriate city staff research surrounding cities to see how similar situations are dealt with.

Mayor Byard informed Ms. Morris that Municipal Court currently issues fines to pet owners for dogs running at large.

Dr. Lavandolyn Robinson, 118 Cosby Court, Prattville, AL 36067, appeared before the Council to express her interest in serving Council District 2, as well as other areas of our city. Dr. Robinson also expressed her appreciation to Mayor Byard for his open-door policy.

Councilman Renegar thanked Dr. Robinson for offering her services to the community and encouraged her to get involved with the Boys and Girls Club.

Councilman Wood thanked Dr. Robinson for her support and assured her that he will call on her in the future.

MAYOR’S REPORT:

Mayor Byard expressed his sympathy to the family of Mr. Fred Posey who passed away. Mr. Posey served as the Autauga County Circuit Clerk from 1941-2001.

The Mayor encouraged everyone to attend the Prattville High School State Championship game which is scheduled for Saturday, December 8, 2007, in Birmingham.

COUNCIL REPORTS:

Council President Argo reported that the Finance Committee met regarding Ordinance numbers 5 and 6 and it recommended that they be introduced and held until the December 18th council meeting.

1. RESOLUTION: TO GRANT A RETAIL TABLE WINE ON-PREMISE AND OFF-PREMISE AND RETAIL BEER ON-PREMISE AND OFF-PREMISE TO WILLIAM AND TAMMY WARD D/B/A THE CELLAR AND SUCH. (RESOLUTION BOOK 2007-A, PAGE 073).

A public hearing was held at 6:00 p.m. this evening. Councilman Macready made a motion to adopt the Resolution and Councilman Gillespie seconded the motion. There being no discussion, the Resolution was adopted (6-0) with the following vote:

2. RESOLUTION: TO GRANT A LOUNGE, CLASS II PACKAGE STORE LICENSE TO JOYCE J. BAKER D/B/A J. BAKER, INC. (RESOLUTION BOOK 2007-A 074).

A public hearing was held at 6:00 p.m. this evening. Councilman Gillespie made a motion to adopt the Resolution and Councilman Macready seconded the motion. There being no discussion, the Resolution was adopted with the following vote:

AYES: GILLESPIE, WOOD, MILLER, ARGO, RENEGAR, MACREADY

3. ORDINANCE: PETITION FOR ANNEXATION OF 227 AND 229 COUNTY ROAD 29. (ORDINANCE BOOK 2007, PAGE 028).

The Ordinance was held from the November 20th council meeting. During discussion, Councilman Gillespie stated that while he encourages members of the Council to support this petition for annexation, he will abstain. The Resolution was adopted with the following vote:

4. ORDINANCE: PETITION FOR ANNEXATION OF 261 COUNTY ROAD 29. (ORDINANCE BOOK 2007, PAGE 029).

The Ordinance was held from the November 20th council meeting. There being no discussion, the Ordinance was adopted with the following vote:

5. ORDINANCE: TO APPROVE AN APPLICATION SEEKING PERMISSION TO INCORPORATE AN EDUCATIONAL BUILDING AUTHORITY OF THE CITY OF PRATTVILLE AND AUTHORIZING SUCH INCORPORATION.

Councilman Miller made a motion to adopt the Ordinance and Councilman Gillespie seconded the motion. By point of order, the Ordinance was held until the December 18th council meeting.

6. ORDINANCE: TO APPROVE AND APPOINT DIRECTORS TO SERVE AS THE GOVERNING BODY OF THE EDUCATIONAL BUILDING AUTHORITY OF THE CITY OF PRATTVILLE.

Councilman Renegar made a motion to adopt the Resolution and Councilman Miller seconded the motion. By point of order, the Ordinance was held until the December 18th council meeting.

7. RESOLUTION: TO AWARD BID NO. 07-027 TO ZOLL MEDICAL CORPORATION FOR EIGHT (8) MONITORING DEFIBRILLATORS FOR THE FIRE DEPARTMENT. (RESOLUTION BOOK 2007-A, PAGE 075).

Councilman Miller made a motion to adopt the Resolution and Councilman Gillespie seconded the motion. There being no discussion, the Resolution was adopted with the following vote:

AYES: GILLESPIE, WOOD, MILLER, ARGO, RENEGAR, MACREADY

8. ORDINANCE: TO DISPOSE OF VARIOUS EQUIPMENT FROM THE INFORMATION TECHNOLOGY DEPARTMENT TO THE LANDFILL. (ORDINANCE BOOK 2007, PAGE 030).

Councilman Wood made a motion to adopt the Ordinance and Councilman Gillespie seconded the motion. Councilman Wood made a motion to suspend the rules and Councilman Gillespie seconded the motion. The rules were suspended 6-0. There being no discussion, the Ordinance was adopted with the following vote:

9. RESOLUTION: TO AWARD BID NO. 07-024 TO JACE CHANDLER & ASSOCIATES FOR THE PURCHASE OF TWO (2) SPEED MONITORING RADAR TRAILERS FOR THE ENGINEERING DEPARTMENT. (RESOLUTION BOOK 2007-A, PAGE 076).

Councilman Gillespie made a motion to adopt the Resolution and Councilman Macready seconded the motion. There being no discussion, the Resolution was adopted with the following vote:

CLOSING COMMENTS:

On behalf of the Department Heads, Mayor Byard thanked the Council for the re-appointment of their positions.

Mayor Byard reminded councilmembers of the letter that Leisure Services Director Drew Peterson received from the Alabama High School Athletic Association (AHSAA) regarding the question he posed about smoking at city parks.

Councilman Gillespie thanked city staff for the additional work involved in making the Christmas parade successful.

Councilman Miller stated that the letter received from the AHSAA did not specifically answer Mr. Peterson’s question. Councilman Miller asked Mr. Peterson to specifically ask if the AHSAA prohibits passes out during the games.

Councilman Renegar expressed his condolences to the Posey family. Regarding the determination of passes out, Councilman Renegar stated that the issue will be taken under advisement by the Leisure Services Committee.

Councilman Macready stated that he would like to be included in the discussion regarding city parks.

Council President Argo expressed his sympathy to the family of Jeff Harrison whose father-in-law was killed in an automobile accident last weekend.

There being no further business to come before the Council, Councilman Macready made a motion to adjourn and Councilman Gillespie seconded the motion. The meeting closed at 7:50 p.m.
