PUBLIC HEARING MINUTES
TUESDAY, JULY 7, 2009

CALL TO ORDER: The Prattville City Council met in public hearing on Tuesday, July 7th at 6:00 p.m. in the Council Chambers at City Hall. Council President Pro-Tempore Miller called the meeting to order. Roll was called and Council President Argo, Councilman Renegar and Councilman Boles were recorded as being absent.

AGENDA

1. RESOLUTION: TO DECLARE VARIOUS WEEDED LOTS TO BE A PUBLIC NUISANCE AND ORDERING THEIR ABATEMENT PER TITLE 11, CHAPTER 67 OF THE CODE OF ALABAMA, 1975, AS AMENDED.

No one appeared in favor of the Resolution.

Mark Andrews, 317 Cambridge Street, Prattville, AL 36066, appeared before the Council to state that he has brought his property up to code.

City Planner Joel Duke stated that all properties listed in the Resolution have been brought up to code with the exception of 163 Primrose Drive and 133 Warwick Drive.

Councilman Renegar and Councilman Boles arrived at 6:03 p.m.

2. ORDINANCE: TO REQUEST TO REZONE PROPERTY LOCATED AT 625-A DURDEN ROAD FROM R-3 TO B-2.

Chip Cleveland, Attorney for S&M Concrete appeared before the Council in favor of the rezoning request. He provided an aerial photo of the business location and other photos to show that $100,000.00 had been spent in improvements to the property, which had once been a gravel pit. He further stated that it will be a financial hardship on the business owner if the Council does not approve the Ordinance.

City Planner Joel Duke stated that the building permit which was obtained by S&M Concrete was for an accessory structure. It was not represented to the City that the building permit was to be used as a business.

Councilman Wood asked Mr. Duke at what time it was determined the business had built in a residential area. Mr. Duke stated that during routine inspection of the building construction, employees from the Fire Department reported that it was in fact a business and not a residence. The Planning Department informed the owner that it was necessary to request a rezoning from R-3 to B-2.

The following citizens spoke in opposition to the rezoning request:

Bob Debardelaben, 1127 Durden Road, Prattville, AL 36067.

T.T. Ray, 823 Durden Road, Prattville, AL 36067.

Jeff Tucker, 505 Durden Road, Prattville, AL 36067.

Lynne Parrish, 630 Durden Road, Prattville, AL 36067.

Bill Parrish, 630 Durden Raod, Prattville, AL 36067.

Mary Voll, 620 Durden, Prattville, AL 36067, representing her disabled neighbor.

Comments included that they were not opposed to the appearance of the building for this particular concrete business, but they did share concerns for increased traffic including heavy equipment on Durden Road. They also expressed their frustrations about a business which did not follow the City’s rules and regulations regarding the construction of a facility in a residential area. They urged the Council to vote the Ordinance down.

3. RESOLUTION: TO DECLARE VARIOUS WEEDED LOTS TO BE A PUBLIC NUISANCE AND ORDERING THEIR ABATEMENT PER TITLE 11, CHAPTER 67 OF THE CODE OF ALABAMA, 1975, AS AMENDED.

No one appeared in favor of or against the Resolution.

City Planner Joel Duke stated that all properties listed in the Resolution have been brought up to code with the exception of 630 Mimosa Road and 101 7th Street.

ADJOURN:

There being no further business to come before the Council, Councilman Fank made the motion to adjourn and Councilman Gillespie seconded the motion. The meeting closed at 6:36 p.m.
