CALL TO ORDER: The Prattville City Council met in public hearing on Tuesday, November 9, 2009 at 6:00 p.m. in the Council Chambers at City Hall. Council President Argo called the meeting to order. Roll was called and Councilman Boles was recorded as being absent. Councilman Boles arrived at 6:07 p.m. AGENDA
1. ORDINANCE: TO AMEND ORDINANCE BOOK 2003, PAGES 003 AND 005, PRATTVILLE ENVIRONMENTAL TOBACCO SMOKE FOR FOOD AND BEVERAGE ESTABLISHMENTS.
Jose Perez, owner of Jose’s Cantina, appeared before the Council to urge them to reconsider the proposed amendment to the City’s current smoking ordinance. He reminded the Council that he constructed his restaurant to meet all standards of the City’s smoking ordinance just as it was being adopted. He expressed concerns for the number of his employees under the age of 19 years old who will lose jobs if the amendment is approved. Councilman Renegar asked Mr. Perez to clarify that he would not be opposed to the proposed amendment if Millbrook adopted the same Ordinance. Councilman Boles asked Councilman Miller if the amendment would apply to facilities that were built to smoking and non-smoking standards. Councilman Miller clarified that the amendment would only apply to the smoking side of the establishment. Councilman Gillespie questioned Mr. Perez about the location of the delivery of soft drinks and the age of the summer employees who make those deliveries. Mr. Perez stated that, to his knowledge, the summer workers are teenagers and they would not be allowed in his building to unload drinks if the amendment is approved. Pete Audie, 1928 Tara Drive, Prattville, AL 36066, owner of Pratt’s Pub, appeared before the Council to state his opposition to the proposed amendment. Mr. Audie stated that an amendment would most likely cause a 35% decrease in food sales at this restaurant. He also mentioned the number of employees under 19 years of age who would lose their jobs. Chris Zenn, 518 Jasmine Trail, Prattville, AL 36066, manager of Bama Lanes, stated that when Montgomery adopted a smoking ordinance that included an age limit, he lost 30% of his bowlers. He expects the same to happen at his location in Prattville if an amendment is approved. Harvey Russell, 143 North Walnut Street, Prattville, AL 36067, owner of the Café in Prattville Square shopping center, appeared before the Council in opposition to the proposed amendment. Mr. Russell stated that the citizens should be allowed to choose which restaurants to patronize. Kim Hunter, 104 Meadowbrook Court, Prattville, AL 36066, came before the Council in favor of the proposed amendment. Ms. Hunter stated that it has been her observation that the majority of the smokers at Bama Lanes on Friday and Saturday nights are under 21 years of age. Sam Gill and Dana Forst, representatives of the Peers Are Staying Straight Coalition (PASS) came before the Council to urge support of the proposed amendment. Barry Riddle, 490 Greystone, Prattville, AL 36066, appeared before the Council in favor of the proposed amendment. He further spoke on the dangers of second hand smoke. Bobby Caviness, 1604 Guiding Way Lane, Prattville, AL 36067, came before the Council to speak in opposition to the proposed amendment. Council President Argo stated that the Council had received a letter from Martha Ellis in favor of the proposed amendment. A copy of the letter will be made a part of the record. He further stated that he had received a call from Vicki McGuire who stated her opposition to the proposed amendment. Council President Argo recognized Cub Scout Pack 25-Den 5, who attended the meeting for the purpose of earning a badge. Gray Penton is their leader.
ADJOURN:
There being no further business to come before the Council, Councilman Fank made a motion to adjourn and the motion was seconded. The meeting closed at 6:28 p.m.
